Following your work on Europol transparency, Griffeye and Clearview AI, I send you a draft Priority Written Question for the Commission regarding the 67 documents Europol refuses to release on its relationship with Palantir Technologies. You were the MEP who revealed Europol’s use of Griffeye Analyze DI Pro in 2020, so this case directly connects with your mandate in LIBE and JPSG.

Subject: Europol’s refusal to disclose 67 documents on Palantir Gotham and continued use of AI for mass data analysis
According to investigations by Lighthouse Reports, The Guardian and Der Spiegel, Europol identified 69 documents concerning its contractual and operational relationship with Palantir Technologies, including the use of Gotham software for mass data analysis. Europol released only 2 documents and denied access to 67, invoking “public security” under Article 4(1)(a) of Regulation 1049/2001, without a document-by-document harm test. One of the released documents shows Europol even considered legal action against Palantir.
Statewatch confirms Gotham has been used by Europol since 2012 via Capgemini within the “new Europol Analysis System”. Europol stated in 2021 that it terminated the Gotham license. However, the 2024 contract list shows a €112 million IT framework contract, Europol’s largest ever, with traces of Palantir services. The European Ombudsman has already admitted a complaint on this refusal and a decision is pending.
Given that Article 88 TFEU and Article 51 of Regulation 2016/794 require democratic control of Europol, and that Article 52 of the Charter requires any limitation of rights to be necessary and proportionate:
- Will the Commission ensure the full publication of the 69 documents identified by Europol on its relationship with Palantir Technologies, including contracts, performance evaluations, data protection impact assessments and internal correspondence on Gotham?
- Can the Commission provide a detailed, individualised justification for each of the 67 denied documents, specifying the concrete harm to public security that disclosure would cause?
- Does the Commission confirm whether Palantir Gotham is still in use at Europol after 2021, and if so, under which legal basis and oversight by the EDPS, given that the EDPS recommended in 2020 not to engage Clearview AI for breaching the Europol Regulation?
- What guarantees of parliamentary oversight exist today for the use of AI and predictive policing tools at Europol, in view of the AI Act and the risks documented in the Citizen Lab CatalanGate report regarding spyware use in Spain?
